TERMS AND CONDITIONS FOR MEMBERSHIP of The FIERCE Leader Programme

These terms and conditions ("Terms") govern your membership with Craftport Consulting Ltd FIERCE Leader Programme ("the Programme") and outline the rights and responsibilities between you ("Member," "you," or "your") and the Programme, led by the coach and facilitator. By enrolling as a member and accepting these Terms, you acknowledge and agree to abide by all provisions herein. Please read these Terms carefully before proceeding with your membership enrolment.

  1. Membership Enrolment

    • Eligibility: Membership is open to individuals aged 18 years or older. By enrolling, you confirm that you meet the eligibility criteria. We reserve the right to accept or reject applications at our discretion.

    • Enrolment Process: To join as a member, you must complete the enrolment form and make the necessary payment as specified on our website or through our designated platform. By doing so, you agree to provide accurate and complete information.

    • Subscription Fee: Membership requires the payment of a subscription fee, which grants access to coaching services, facilitation sessions, and resources provided by Craftport. The subscription fee is collected at the start of each monthly period, exclusively via Direct Debit/GoCardless. We may periodically adjust the subscription fee, and you will be notified of any changes with at least 30 days' notice.

    • Payment Method: All payments are processed via GoCardless Direct Debit. By enrolling, you authorise Craftport to collect the subscription fee from your designated bank account. To update or change your Direct Debit information, please contact info@craftport.com

  2. Membership Benefits and Obligations

    • Coaching and Facilitation Services: As a member, you will receive access to coaching and facilitation services, including one-on-one coaching sessions, group coaching sessions, and a range of resources tailored to support your growth, depending on the level of membership you select.

    • Intellectual Property: All materials, resources, and content provided by Craftport are protected by intellectual property rights. You agree to respect and uphold these rights by not reproducing, distributing, modifying, or creating derivative works without prior written consent.

    • Non-Transferability: Membership is personal and non-transferable. You may not assign or share your membership or access to resources in the Programme with others.

    • Confidentiality: You agree to maintain the confidentiality of any coaching materials, resources, or information shared during your membership. This includes not disclosing or sharing these with any third party.

    • Time Commitment: If you book time for a 1:1 session, that time is reserved exclusively for you. Craftport can not be held responsible if you miss a scheduled session. Rescheduling or making up missed time is at the sole discretion of the coach and facilitator.

  3. Termination and Cancellation

    • Termination by Member: You may terminate your membership by providing written notice (via email to info@craftport.com) at least 30 days before the desired termination date. No refunds will be issued for any remaining subscription period if you choose to leave early.

    • Termination by Craftport: Craftport reserves the right to terminate your membership for any reason, including but not limited to breaches of these Terms, illegal activities, or disruptive behaviour. Written notice of termination will be provided, and the decision is final. No refunds will be issued in these cases.

    • Refunds: Membership fees are non-refundable except where required by law.

  4. Limitation of Liability

    • Disclaimer: All coaching and facilitation services are for educational and informational purposes only. Craftport does not guarantee specific results or outcomes. Any actions or decisions taken based on these services are at your own risk.

    • Indemnification: You agree to indemnify and hold Craftport, its coach, and representatives harmless from any claims, damages, liabilities, or expenses arising from your membership or use of services.

    • Limitation of Liability: Craftport shall not be liable for any direct, indirect, incidental, consequential, or special damages related to your membership, even if informed of the possibility of such damages.

  5. Confidentiality

    • Confidential Information: Both parties shall keep confidential all information exchanged during the membership. Exceptions apply to:

      • Information already public at the date of the contract;

      • Information that becomes public through no fault of either party;

      • Information independently developed without using the other’s confidential information; or

      • Disclosures required by law or regulation.

    • Duration: This confidentiality obligation remains in effect for five years from the termination of your membership.

  6. Force Majeure

    • Craftport is not liable for delays or failures in performance due to events beyond its control ("Force Majeure"), including but not limited to natural disasters, war, strikes, or interruptions in telecommunications.

    • If a Force Majeure event occurs, the affected party must promptly notify the other and make reasonable efforts to minimise the effects.

  7. Miscellaneous

    • Modifications: Craftport may modify these Terms at any time. Changes will be communicated through our designated channels. Your continued membership after modifications indicates your acceptance of the revised Terms.

    • Governing Law: These Terms are subject to English Law. Any disputes will be subject to the jurisdiction of English courts.

    • Severability: If any part of these Terms is found to be unenforceable, the remainder shall still apply in full force.

    • Notices: All official communications shall be made in writing and sent to the designated addresses, either by post or email, as specified upon enrolment.

    • Entire Agreement: These Terms represent the complete agreement between you and Craftport. No other terms apply.

By enrolling in the FIERCE Leaders Programme, you confirm that you have read, understood, and agree to be bound by these Terms.
